Appellant Tom Tuan Nguyen sued appellees George H. Woodley and Marcy T. Woodley for specific performance on an earnest money contract between the parties involving a home listed for sale in Fort Bend County. The Woodleys counter-claimed for damages resulting from Nguyens alleged breach of the earnest money contract, declaratory relief, and attorneys fees. Both sides submitted motions for summary judgment. The trial court granted the Woodleys motion for traditional and no-evidence summary judgment, and denied Nguyens motion.
